    Permitted development rights grant homeowners the right to undertake certain building works and changes of use without needing to apply for planning permission. When a permitted development right is removed, this is known as an article 4 direction, which we also have as a consideration for the planning system (see more).

      The Town and Country Planning (General Permitted Development) (England) Order 2015, Schedule 2 defines the different permitted development rights.

      There is no legislation that specifies the designation of permitted developments rights as they are national, and can be added or updated as per legislative amendments, and so they go through the legislative process.

    The data design team produced and own the permitted development right (PDR) dataset. It feeds into the article 4 direction dataset as a field to be supplied, which points to the PDR being removed as a result of the article 4. This data was initially produced in a spreadsheet prior to being fed into the platform with references which could be used by local planning authorities for populating fields in their respective article 4 direction datasets.

    This currently looks at the most recent legislation. There is work going on regarding the tracing of PDRs back through time for more accurate data.

    Permitted development rights data would be used for planning and development and local planning authority decision-making. It aids planners and developers in identifying development opportunities, while helping local councils monitor compliance.

    We have a list of permitted development rights that we maintain. It is maintained with the help of the policy team in MHCLG.

    At the moment we review the list periodically or if users let us know something is missing/wrong.

    We need to develop a better process for handling data like this.
