Permitted development rights

Research

These are the questions we answer during the Research stage.

Answering them wil help us learn more about the Permitted development rights consideration, determine if a data standard is required and whether we know enough to move on to the next stage.

  • Do we understand the lifecycle of a Permitted development rights?

  • Do we understand how the data is created/produced?

The data design team produced and own the permitted development right (PDR) dataset. It feeds into the article 4 direction dataset as a field to be supplied, which points to the PDR being removed as a result of the article 4. This data was initially produced in a spreadsheet prior to being fed into the platform with references which could be used by local planning authorities for populating fields in their respective article 4 direction datasets.

This currently looks at the most recent legislation. There is work going on regarding the tracing of PDRs back through time for more accurate data.

  • Where will or should the data be used?

Permitted development rights data would be used for planning and development and local planning authority decision-making. It aids planners and developers in identifying development opportunities, while helping local councils monitor compliance.

    • Local plans - Permitted development rights are occasionally referenced in local plans, so we think that this consideration feeds into the process of creating a local plan.

  • Who are the statutory consultees for Permitted development rights?

  • Other than the statutory consultees who are the primary users of Permitted development rights? How do we expect them to use Permitted development rights?

  • What are the planning needs for this data?

Permitted development rights are vital in planning as they allow certain developments to proceed without a full planning application, saving time and resources. It is also important that there is a balance of these rights with considerations for local character, environmental impact, and community interests to ensure sustainable development.

  • Who are the types of users who might benefit from having access to Permitted development rights data?

  • What are some potential uses of Permitted development rights data?

  • What's the value of adding Permitted development rights data to the platform?

Permitted development rights are vital in planning as they allow certain developments to proceed without a full planning application, saving time and resources. It is also important that there is a balance of these rights with considerations for local character, environmental impact, and community interests to ensure sustainable development.

  • From what we have learnt so far are there any risks to making Permitted development rights data available?

As we in the data design team maintain this data, there is a chance that as the legislation is updated and amended, we slip behind on it from our side, with the permitted development rights we show therefore being outdated.
